By engaging with the spiritual consultations, energy-based readings, or any form of guidance offered by Sushain Maharaj, either directly or through SMS Foundation, you acknowledge, understand, and agree to the terms and conditions outlined below.

1. Nature of Services – Spiritual, Non-Scientific and Based upon energy Speculations

The services offered by Sushain Maharaj are spiritual in nature and based on his personal ability to intuitively read, interpret, and respond to subtle energy fields. These services are not rooted in scientific, medical, or psychological frameworks, and do not claim to be measurable or empirically validated. They are shared with genuine intent, rooted in spiritual understanding, for those who seek personal reflection and energetic clarity.

2. No Promises, No Guaranteed Outcomes

While Sushain Maharaj aims to provide sincere and meaningful insights, no assurance or certainty is given regarding the accuracy, completeness, or outcome of any guidance, prediction, or interpretation. Energy is dynamic and influenced by many factors—seen and unseen. Therefore:

• No results are promised
• No event or condition is guaranteed
• No absolute predictions are offered

Clients are encouraged to treat all guidance as supportive insight, not definitive answers.

5. Voluntary Participation & Personal Responsibility

Your decision to participate in any service or session is entirely voluntary. You agree to:

• Take full responsibility for any decisions or actions you take
• Understand that insights provided are interpretive, not instructional
• Accept that the service is a tool for contemplation, not a fixed path or solution

6.  Limitation of Liability

SMS Foundation, Sushain Maharaj, and their affiliates or representatives shall not be liable for any form of:

• Emotional distress or mental impact
• Financial or reputational loss
• Relationship issues or personal conflicts
• Health outcomes or physical discomfort
• Self-harm, injury, or unintended consequences

You accept that no liability or compensation shall arise from your use of these services, and all outcomes remain your sole responsibility.

7.  Indemnification

You agree to indemnify and hold harmless SMS Foundation, Sushain Maharaj, and all related persons from any and all claims, losses, liabilities, legal proceedings, damages, or expenses— including legal fees—arising from your participation in or reliance on any consultation or content provided.

8. No Legal Claims Permissible

By participating in any form of consultation or prediction, you waive all rights to initiate any legal proceedings, complaints, or lawsuits—civil or criminal—against SMS Foundation or Sushain Maharaj. This includes consumer cases, online defamation, or service-related disputes.

9. Consent and Understanding

By availing any service, you affirm that:

• You have read and understood this disclaimer in full
• You are over 18 years of age and mentally competent
• You voluntarily accept all terms, without pressure or influence
• You understand that spiritual guidance is interpretive, not guaranteed

10. Right to Refuse Service

SMS Foundation and Sushain Maharaj rese4rve the absolute right to refuse, discontinue, or withdraw services to any individual, at their sole discretion, without the obligation to disclose reasons.

11. Content and Ownership

All predictions, guidance, or advice provided by Susen Maharaj during any online session are the sole intellectual property of SMS Foundation. Any use, distribution, or publication of the content, in full or in part, without prior written consent from SMS Foundation is strictly prohibited.

• Prohibition on Recording:

Recording, screenshotting, screen capturing, or any form of reproduction of the session — whether through mobile, computer, or any electronic/digital device Is strictly Unauthorized recording or circulation shall result in immediate termination of the ongoing session and may attract legal action, including but not limited to civil and criminal proceedings.

• Session Confidentiality:

These sessions are private and meant solely for the individual participant. Sharing login details, streaming, or allowing third-party access to the session is not permitted. Violation of this clause will lead to the cancellation of the session and blacklisting of the participant from future engagements.

• Jurisdiction:

Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh.

12. JURISDICTION & LEGAL DISCLAIMER CLAUSE

1. Nature and Scope of Services

The services rendered under the title Sushen Prediction Model comprise spiritual, intuitive, and motivational discourses and predictions conducted by Sushen Maharaj, delivered through in-person consultations, online platforms, seminars, or public events.

These services are grounded in ancient Indian spiritual traditions and intuitive faculties and are intended solely for personal guidance and motivational purposes. They do not constitute medical, astrological, legal, psychological, or financial advice, nor do they involve or promote occult practices, black magic, superstition, or miraculous healing.

2. Legal Disclaimer

The Provider hereby expressly states and the Participant/Client acknowledges and agrees that:

a). The services offered do not fall within the ambit of:

• The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954;

• Any other State or Central legislation prohibiting black magic, superstition, or fraudulent spiritual practices (including, but not limited to, the Maharashtra Black Magic Act and analogous laws in other jurisdictions);

• BHARTIYA NYAYA SANHITA 2023 provisions relating to cheating, fraud, or wrongful gain through deception.

b). All guidance provided under the Sushain Prediction Model is rendered in good faith, intended for spiritual enrichment and clarity of thought, and is non-binding.

c). Participation is voluntary, and the Participant/Client exercises their own discretion and judgment in acting upon any advice received.

3. Jurisdiction – Domestic (India)

All disputes, controversies, or claims arising out of or in connection with services rendered within the territory of India—whether physically or through digital mediums—shall be subject to:

• The laws of India, and

• Exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh.

The Participant/Client expressly and irrevocably waives any right to contest jurisdiction elsewhere within India.

4.   Jurisdiction – International Access (Online Participation from Outside India)

In cases where users/participants located outside India access services via the internet or any digital platform:

a). The services shall be deemed to have been rendered within the territory of India;

b). Any claim, dispute, or legal proceeding arising from such access shall be:

• Governed exclusively by the laws of India; and

• Subject to the exclusive jurisdiction of the competent courts at Lucknow, Uttar Pradesh.

The user hereby waives any and all objections to such jurisdiction, including those based on forum non conveniens or any similar doctrines under foreign law.

5.   Jurisdiction – Physical Events/Programs Conducted Outside India

For any events, retreats, seminars, or public discourses organized under the Sushain Prediction Model in a foreign jurisdiction (i.e., outside the territorial limits of India):

a).  Such events shall be classified as non-commercial, spiritual and cultural exchanges, not involving any form of magical, occult, or supernatural demonstration.

b). Notwithstanding the geographical location of such events, any dispute, claim, or controversy arising therefrom shall:

• Be construed under the laws of India, and

• Be subject to exclusive jurisdiction of the courts situated in Lucknow, Uttar Pradesh,

The participant or attendee expressly agrees and consents to the above jurisdiction clause as a pre-condition for participation in such events.

6.   Governing Law

This Agreement and all matters arising out of or relating to it shall be governed by and construed in accordance with the laws of India, without regard to any conflict of law principles.

7.   Severability

If any provision or part thereof of this clause is found to be invalid, unenforceable, or contrary to law, it shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

8.   Binding Consent Clause (For Inclusion in Forms)

“I, the undersigned, hereby declare that I have read and understood the above legal disclaimer and jurisdiction clause and voluntarily agree to be bound by the same. I acknowledge that the services provided under the Sushain Prediction Model are spiritual in nature and do not constitute any form of black magic or occult practice. I further agree that all disputes arising therefrom shall be governed by Indian law and subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh, India.”
